Application of these Terms
These terms and conditions (Terms) apply to all orders for products sold on our website (Products).
1. Orders
1.1 Please note that a product’s true colour may not exactly match that shown on your computer or device or in our marketing, or its packaging may be slightly different.
In order to place orders for our Products via our website, you must be legally capable of entering into a binding contract with us (e.g. you must be at least 18 years old).
1.3 By ordering the Products through the website, you are deemed to have understood and accepted these Terms.
1.4 We may also email you an order acknowledgement email as soon as possible after receiving your order. However, this email just acknowledges our receipt of your order and does not indicate acceptance of your order. Acceptance of your order will not take place until you receive an email confirming acceptance of your order and/or the despatch of your order, at which time a contract will come into existence between you and us unless we notify you that we are unable to accept your order as set out in clause 1.5 below.
1.5 If we are unable to accept your order, or we are not able to supply any Products in your order (for example, if a Product is out of stock, we are not able to obtain payment from you, or we have detected an error in the price or description of a Product), we shall notify you of this. If you have actually paid for your order, we shall refund the amount paid for that order or Product(s) concerned, as the case may be. Except as provided in this clause, we shall have no liability to you regarding any variation or cancellation of your order.
2. Price
2.1 Our pricing can be found on our website. We take all reasonable care to ensure that the prices stated on our website for the Products are correct. There may be occasions when, despite our best efforts, some of the Products offered for sale on our website may be incorrectly priced. If we discover a pricing error before dispatching the Product to you, where the correct price of the Product when your order is received by us is higher than our stated price on the website, we will contact you immediately to inform you of the mistake and offer you the option of continuing with the sale of the Product at the correct price, or canceling the Product. If we in error accept and process your order for a Product and the error in the purchase price of the Product was obvious and unmistakeable and could be reasonably recognized by you as a pricing error, we may end the contract, return the monies you have paid to us, and ask for the return of the Products to us. Please note that all prices, discounts, and promotional offers displayed on our website are subject to change without notice.
2.2 Prices are indicated with the appropriate currency on the website.
2.3 The price of a Product includes VAT, if applicable, at the prevailing rate applicable for the time being. The price of a Product does not include delivery charges. Please refer to our Shipping & Returns Policy for information about our delivery charges.
3. Payment
3.1 The accepted payment methods are highlighted during the checkout process on our website. For further details regarding the same, please refer to our Payment Methods page. Payment for the Products will be taken from the chosen payment method selected by you at the time of placing the Order. In the event you place an Order for the Products which are not in stock but are available for pre-order, the payment will be taken at the time of placing the Order.
3.2 The method of making payments by means of a discount code or gift card, etc., may be subject to further conditions or limitations, as applicable to the particular codes or cards.
4. Delivery
4.1 Your order will be delivered to you in instalments.
4.2 The cost of delivery, where we deliver to, and estimated delivery times are included in our Shipping & Returns Policy. If you place an order for Products that are currently out of stock but can be pre-ordered, the estimated time that the Products will take to be delivered is mentioned on our website or during the checkout process; however, we must stress that this is an estimated time.
4.3 Depending upon the location of the delivery and the method of the delivery you have chosen, it is possible that you might have to sign for the delivery of the Products. If our delivery partner has not been able to deliver the Products to you, they will leave a note or contact you to let you know how to reschedule the delivery of the Products or arrange the collection of the Products from a local depot.
4.4 Where our partner in the contract of delivery has been unable to deliver the Products to you but the fault lies in nothing but your failure to arrange for the collection of the Products from the depot to where they have been held prior to delivery in accordance with our instructions, the contract for the return of the Products to us by the partner in our contract of delivery will be deemed to be terminated, and in such a case where the contract has to be terminated for our own protection, whilst we shall be obliged to return the purchase price of the Products to you, we shall be entitled to retain the charges for the delivery of the Products to you as a deduction from the return price of the Products.
4.5 The delivery of the order shall be considered to be complete in circumstances where we deliver the products to the address provided to us by you, or to the person or address identified by you to receive the products, and the products and the risk of loss thereof will be entirely your responsibility.
4.6 You will own the Products once we have received payment in full.
5. Returning your product
5.1 If you want to return a Product, you must notify us within 14 days of receiving the Product and return it to us within 14 days of notification. You must obtain a return from our returns portal on our website to obtain a returns label and ‘return merchandise authorisation’ (RMA) number.
5.2 If you consider that any product we have supplied is faulty or mis-described, please notify us via the returns portal. If the Products are faulty or mis-described we will give you a refund.
5.3 If you are a consumer, you have a legal right to cancel your contract if you change your mind within 14 days after you receive the Products. This right does not apply to personalised items or hygiene-sensitive items (underwear, socks, swimwear).
5.4 You must return the Products no later than 14 days after informing us of cancellation. Products must be reasonably unused and in original packaging.
5.5 We shall refund the amount you paid within 14 days of receiving the returned Products.
6. Events outside our control
6.1 We will not be liable for any failure to perform or delay caused by acts beyond our reasonable control, including strikes, natural disasters, or failure of public telecommunications networks.
7. Intellectual property rights
7.1 All intellectual property rights in our Products and on the Site are owned by VYBN or our licensors.

10.2 We may transfer our rights and obligations to another organisation.
10.7 Applicable Laws – The laws that govern these Terms are the laws of the jurisdiction in which VYBN is registered.
